Terms of Service for ApplyAssists
Please read these Terms of Service (“Terms,” “Agreement”) carefully before using the website and services operated by SC ApplyAssists SRL.
Your access to and use of ApplyAssists (the “Service”), including our website located at applyassists.com and our application at app.applyassists.com, is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
1. Acceptance of Terms & Eligibility
You represent that you are at least 16 years of age (or the age of legal majority in your jurisdiction) and are fully able and competent to enter into and abide by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
ApplyAssists is an AI-powered platform that assists users in creating, formatting, optimizing, and tailoring curriculum vitae (CVs), resumes, and cover letters. The Service includes features for document generation, ATS compliance suggestions, and job application tailoring using artificial intelligence.
3. User Accounts & Registration
You must create an account to access most features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Subscription Plans, Fees, and BYOK Feature
a) Subscription Tiers:
We offer the following subscription plans:
- BYOK Tiers: Grants access to our CV building and tailoring tools, requiring you to provide your own OpenAI or Gemeni API key. Billed at $10 per month or $20 for a 3-month period.
- Professional Tier: Provides unlimited use of our AI generation features using our API. Billed at $19 per month.
b) Payment and Billing:
All fees are payable in advance and are non-refundable, except as required by applicable law. By subscribing, you authorize us to charge the provided payment method on a recurring basis for the chosen subscription period until you cancel.
c) Service Access Post-Subscription:
If your subscription expires or is canceled, your access to AI generation features (or, for BYOK tiers, the platform tools) will be suspended. You will retain the ability to log in to view, download, and delete your existing documents and data.
d) "Bring Your Own Key" (BYOK) Feature:
If you use the BYOK feature, you are solely responsible for:
- Providing and maintaining a valid OpenAI or Gemeni API key.
- All costs incurred through your use of the OpenAI or Gemeni API.
- Complying with OpenAI’s or Gemeni’s own Terms of Service and Privacy Policy.
We are not a party to your relationship with OpenAI or Gemeni. We transmit your prompts and data to the OpenAI or Gemeni API on your behalf but have no control over, and assume no responsibility for, OpenAI’s or Gemeni’s processing, service availability, or costs.
5. User Content, Data, and Ownership
a) Your Data:
You retain full ownership of all personal data, professional information, job descriptions, and the final content of the CVs, resumes, and cover letters you create or input into the Service (“Your Content”). You are solely responsible for the accuracy and legality of Your Content.
b) License You Grant to Us:
To operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, and transmit Your Content solely for the purpose of providing, improving, and securing the Service (including processing it through third-party AI providers as described in our Privacy Policy).
c) Our Intellectual Property:
The Service, its original content (excluding Your Content), features, functionality, and underlying technology are and will remain the exclusive property of SC ApplyAssists SRL and its licensors. Our trademarks, trade dress, and logos may not be used without prior written permission.
6. Acceptable Use & AI Responsibility
You agree not to misuse the Service. Prohibited activities include, but are not limited to:
- Using the Service for any illegal purpose or to violate any laws.
- Attempting to breach or test the vulnerability of our systems.
- Using the Service to generate fraudulent, deceptive, plagiarized, harassing, or discriminatory content.
- Reselling or commercially exploiting the Service without our permission.
AI-Generated Content Disclaimer
7. Account Termination
You may delete your account and Your Content at any time through your account settings or by contacting support. Upon deletion, your data will be handled as described in our Privacy Policy.
We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
8. Disclaimers & Limitation of Liability
a) Disclaimer:
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
b) Limitation of Liability:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SC APPLYASSISTS SRL, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
9. Indemnification
You agree to defend, indemnify, and hold harmless SC ApplyAssists SRL and its licensees and licensors from and against any claims, damages, liabilities, losses, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
10. Governing Law & Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts located in Timișoara, Timiș, Romania.
Prior to pursuing formal legal action, you agree to attempt to resolve the dispute informally by contacting us first at support@applyassists.com.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the “Last Updated” date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
